WATER ADAPTIVE SPORTS, AC, (hereinafter “Surfeando Sonrisas”) with address at Avenida Prolongación San Antonio number 133, 5th floor, Colonia Carola, Álvaro Obregón, Mexico City, and internet portal www.surfeandosonrisas.org is responsible for of the use and protection of your personal data.

The foregoing, in accordance with the Federal Law for the Protection of Personal Data Held by Private Parties (hereinafter referred to as the "Law") and in this regard we inform you of the following: 

 

Surfing Smiles is a non-profit institution with the aim of improving the quality of life of children, youth and adults with disabilities (PcD) through the practice of adapted water sports (and other sports) especially surfing, holding events and clinics during all year. This Privacy Notice is addressed to participants, volunteers, instructors and people who intend to contribute resources through donations in favor of Surfeando Sonrisas, for which personal data will be used for the following purposes:

PURPOSES OF THE PROCESSING OF PERSONAL DATA.

Surfeando Sonrisas will use the personal data collected from the Owner for the following purposes, which are necessary for the relationship that the Owner maintains with Surfeando Sonrisas:

MAIN PURPOSES.

Participants

  • For the registration of participants in the events and clinics organized by Surfeando Sonrisas.
  • Verification of the information provided by the attended participants regarding their medical history and current state of health.
  • Security and surveillance of participants in events and clinics.
  • Make a list of participants and keep a file on each one.

donors

  • To identify, locate and contact donors to issue the tax receipts that are required in cases of donations.
  • Registration and monitoring of contributions from donors in the Surfeando Sonrisas database.
  • Process orders and purchase requests derived from donations in kind, of the products that Surfeando Sonrisas makes available on the Website.

Volunteers

  • For the recruitment, selection and administration of Surfeando Sonrisas volunteers.
  • For the registration of volunteers in the orientation course organized by Surfeando Sonrisas.
  • Management, control and administration of volunteer assistance.
  • Management, control and administration of activities assigned to volunteers

instructors

  • To have sufficient data during the selection process and, where appropriate, admission as an instructor of Surfeando Sonrisas.
  • Management, control and administration of the attendance of the instructors.
  • For the Registration of instructors in the training course in order to help children safely and optimally in the various aquatic activities organized by Surfeando Sonrisas.

SECONDARY PURPOSES.

Additionally, we will use your personal information for the following purposes that are not necessary for the requested service, but that allow us to provide you with better service.

  • Evaluate the quality and functionality of the services and the Website.
  • Evaluation of the quality of our products and services.
  • Sending commercial and advertising information, as well as promotional information, by any means.
  • Inform about changes and/or updates to the Website, the terms and conditions and this Privacy Notice.
  • Identification of vulnerable activities and compliance with the obligations set forth in the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin, especially the provisions of article 17 section XIII and other applicable regulations.
  • Keep your information for compliance with applicable legislation and regulations.

In the event that you want your personal data not to be used for any of the secondary purposes described in this section, you must send an email with your request to contact@surfeandosonrisas.org indicating the purpose or purposes for which you do not want your personal data to be processed.

The refusal to use your personal data for these purposes may not be a reason for us to deny you the services and products you request or contract with us.

Surfeando Sonrisas will use the personal data mentioned below to fulfill the purposes described in this Privacy Notice:

  • Constitutive Act.
  • Current official identification of the Legal Representative or Agent.
  • Public instrument in which the powers of representation are stated.

  • Data and information for billing.

TREATMENT OF SENSITIVE PERSONAL DATA OF PARTICIPANTS.

According to the Law, sensitive personal data are those personal data that affect the most intimate sphere of its owner, or whose improper use may give rise to discrimination or entail a serious risk for it, for which we inform you that in addition to personal data mentioned above, for the purposes reported in this privacy notice we will use the following personal data considered sensitive and that require special protection:

  • Health data: Information concerning the type of disability of the participants, which may be physical or intellectual, mobility equipment or specifications required according to their disability.

 Your consent in relation to the handling of this data must be express, in order to comply with the provisions of article 9 of the Law. The foregoing except the provisions of article 10 thereof.

VIDEO SURVEILLANCE (PARTICIPANTS, INSTRUCTORS AND VOLUNTEERS).

For the purposes described in this Privacy Notice, Surfeando Sonrisas may collect audio photographs, videos related to participants, instructors and volunteers or, where appropriate, minors, during their participation in events and clinics organized by Surfeando Sonrisas. In the case of minor participants, the activities will be carried out with the knowledge and express written consent of the parents and/or guardians of said minors, and exclusively for the purposes listed here.

Parents or guardians of minors may at any time exercise the rights recognized by law in relation to the personal data of minors under their care, and direct any clarification on the use of such data to the person responsible, through the means established in this Privacy Notice.

ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION TO THE PROCESSING OF YOUR PERSONAL DATA.

In accordance with the Law, you have the right to know what personal data we have about you, what we use them for and the conditions of use that we give them, as well as to know this Privacy Notice to which their treatment is subject (Access ). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate, incomplete or erroneous (Rectification); that we remove it from our records or databases when you consider that it is not being used properly (Cancellation); as well as oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights. 

Keep in mind that the Cancellation of personal data will give rise to a blocking period after which the data with respect to which this right has been exercised will be deleted. Surfing Smiles may keep said data exclusively for the purposes of the responsibilities arising from the processing of said personal data, either because the personal data derive from a private, social or administrative contract and are necessary for the development of the same and its fulfillment; must be treated by legal provision; are necessary to comply with an obligation acquired by the holder; and all others provided by Law. The aforementioned blocking period will be equivalent to the prescription period of the actions derived from the legal relationship that grounds the treatment in the terms of the Law applicable in the matter. 

Once the data(s) have been cancelled, the Holder will be notified. 

To exercise any of the ARCO rights, you must submit the respective request to the person responsible for personal data, so that the Holder's request can be processed, through the following means:

Regarding the procedure and requirements for the exercise of your ARCO rights, we inform you of the following: 

Only you or your legal representative may make such requests, for which it will be necessary to prove your quality as Owner.

PROOF OF IDENTITY, OWNERSHIP AND PERSONALITY.

Individuals: Valid official identification.

Moral person: constitutive act, current official identification of the legal representative or attorney-in-fact and power of attorney of the legal representative stating the sufficient powers to act on behalf of the owner in terms of the law.  

INFORMATION OR DOCUMENTATION THAT MUST BE CONTAINED IN THE APPLICATION.

  1. Full name and email of the Owner
  2. Documents that prove the identity or, where appropriate, the legal representation of the Holder.
  3. The clear and precise description of the personal data with respect to which one seeks to exercise any of the aforementioned rights.
  4. Any other element or document that facilitates the location of personal data.

Likewise, in the event that the request is made for the rectification of personal data, the owner must indicate the modifications to be made and provide the documentation that supports his request.

TERM AND A HALF OF RESPONSE TO YOUR REQUEST.

Surfeando Sonrisas will respond to your request 15 fifteen calendar days from the date on which the request for access, rectification, cancellation or opposition was received. 

Surfeando Sonrisas may extend said term for an equal period and one single occasion, provided that the circumstances of the case so justify.  

Surfing Smiles will address your response via email to the one you have stated in your request.

MECHANISM AND PROCEDURE TO REVOKE YOUR CONSENT TO THE PROCESSING OF YOUR PERSONAL DATA OR LIMIT ITS USE OR DISCLOSURE.

You may revoke the consent you have given us for the processing of your personal data. However, it is important that you take into account that not in all cases we will be able to attend to your request or terminate the use immediately, since it is possible that due to some legal or contractual obligation we need to continue processing your personal data. In the event that you revoke your consent, Surfeando Sonrisas will not be able to maintain a contractual or service relationship with you.

Likewise, in accordance with article 16 of the Law, you may limit the use and/or disclosure of your personal data.

TRANSFER OF PERSONAL DATA.

Surfing Smiles will not transfer your personal data to third parties.

In the event that the Owner uses the Surfeando Sonrisas web portal, we inform you that we use cookies, web beacons and other tracking technologies in terms of this Privacy Notice.

We remind you that you can disable or adjust the use of cookies following the procedures of the internet browser you use to access our websites.

MODIFICATIONS TO THE PRIVACY NOTICE.

This privacy notice may undergo modifications, changes or updates derived from new legal requirements; our own needs for the products or services we offer; of our privacy practices; Changes in our business model, or other causes.  
We promise to keep you informed about any changes that this privacy notice may undergo by posting it on the website. contact@surfeandosonrisas.org and through posters in Surfeando Sonrisas branches.

MODIFICATIONS TO THE PRIVACY NOTICE.

If you consider that your rights regarding the protection of personal data have been violated, you have the right to go to the corresponding authority to defend your exercise.
